ACCEPTABLE USE POLICY

Rules and obligations for all users of Outbound Contact Client Services.

Overview

This policy is applicable to all Outbound Contact Client Services that may be used for transmitting bulk emails or commercial emails (“Client Services”).

You agree to Outbound Contact Anti-Spam Policy as a precondition to use of Client Services. Client Services may be used only for sending mails or messages to persons from whom you have an express permission to send mails or messages on the subject of such mail or message, such as permission-based email marketing.

We take our Anti-Spam Policy very seriously. If we discover that you are sending emails or messages to people without their permission, we reserve the right to terminate your user account.

What Constitutes “Permission”

By “permission” we mean express and provable permission granted to you. Permission may be obtained when:

  • The user submits their email address while downloading something from your website or ordering a product or service.
  • The user subscribes to your email newsletter through a web form.
  • The user participates in a contest, event, or survey and is informed that marketing emails will follow.
  • The user checks an opt-in checkbox indicating willingness to receive commercial messages (checkbox must be unchecked by default).
  • You receive a business card from a person expressing interest in receiving commercial emails—including cards dropped at trade show booths.

Rule of Thumb: Do not use Client Services to send emails or messages to any address for which you do not have explicit permission.

"100% compliance" does not include cases where a recipient marks a permitted email as spam. However, permission is revoked if the user opts out of future communications.

Specific Requirements and Restrictions

You must strictly comply with the following rules:

  • You must have explicit permission to contact the recipient on the subject of your email and be able to provide proof of permission.
  • You may not import or send emails to purchased, rented, loaned, or third-party-provided lists without express approval from an Outbound Contact representative.
  • You may not use email addresses collected from other websites without proper consent and verification.
  • Your “From,” “To,” domain name, and email routing information must be truthful and accurate.
  • Subject lines must not mislead recipients about the contents of the message.
  • You must include your valid physical postal address in all emails sent through Client Services.
  • Legal and Real Estate Client Services users must clearly state that the email is an advertisement or solicitation and provide an opt-out option.

Outbound Contact may at any time require you to prove that you have obtained permission for every email address imported into your account.

Your continued use of Client Services signifies full acceptance of this Anti-Spam Policy.
